1. Agreement

These Terms of Service ("Terms") govern your use of qualityestatejewelry.com and any purchase you make from us. The website is operated by Quality Estate Jewelry LLC, doing business as Quality Estate Jewelry ("Quality Estate Jewelry," "we," "us," or "our"). By using the website or placing an order, you agree to these Terms, our Refund Policy, our Shipping Policy, and our Privacy Policy, which are part of these Terms.

2. How We Sell

Quality Estate Jewelry is an online retailer of estate, vintage, antique, and pre-owned fine jewelry and watches. Many items are offered on consignment from established, professional jewelers ("Consignors").

For every purchase on this website:

• Quality Estate Jewelry is the seller. Your purchase contract is with Quality Estate Jewelry, not with a Consignor.
• We set the retail price, collect payment, and issue your receipt.
• We are responsible to you for the accuracy of item descriptions, order fulfillment, customer service, returns, and refunds.
• Some items ship directly from a Consignor's secure location on our behalf, in Quality Estate Jewelry packaging or plain, unbranded packaging. This does not change who you are buying from.

3. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to make a purchase. If you create an account, you are responsible for keeping your login credentials confidential and for activity under your account. Tell us promptly at support@qualityestatejewelry.com if you believe your account has been accessed without permission.

4. Product Descriptions and Grading Standards

Photography and color. We make every reasonable effort to photograph and describe each item accurately. Colors may look different on your screen due to lighting, camera settings, image processing, and display calibration. Gemstones and metals may appear slightly different in person. Close-up photos may make items look larger than their actual size; please rely on the stated measurements.

Gemstone grading. Unless otherwise stated, gemstones are graded while set in their mountings. Stated weights, dimensions, and grades are approximations using the grading standards and nomenclature of the Gemological Institute of America (GIA). Mountings can limit visibility and measurement, so descriptions of mounted stones are informed professional approximations unless accompanied by a report from an independent gemological laboratory such as GIA or AGL. Diamonds are graded against master comparison stones using GIA terminology; colored stones are assessed using the GIA Colored Stone Grading System and, where appropriate, the Gem Dialogue color framework.

Age, origin, and maker. Determinations of age, decorative period, "circa" dates, origin, and maker attribution are our professional opinion, based on materials, construction, hallmarks, signatures, design, and reference sources. Decorative periods overlap, so these are informed opinions, not guarantees.

Condition. Unless described as new, items are previously owned and may show normal signs of wear consistent with age and use, such as light scratches, patina, polishing marks, or minor wear to metal or stones. Normal age-related wear is not a defect. We disclose condition issues that, in our professional judgment, materially affect an item's appearance, structural integrity, function, or value.

Not an appraisal. Item descriptions, grades, and any "estimated retail" or comparison values are not insurance appraisals. If you need an appraisal, we recommend an independent, credentialed appraiser.

5. Authenticity Guarantee

We guarantee that every item is authentic as described: that branded items are genuine products of the stated maker, and that stated metals are the stated material and karat. If, within 30 days of delivery, an independent, credentialed appraiser, gemological laboratory, or the brand's authorized service center determines in writing that an item is not authentic as described, contact us at support@qualityestatejewelry.com. After we confirm the finding, we will accept the return and refund the full purchase price, including original shipping, with no restocking fee. This guarantee is in addition to our standard Refund Policy.

6. Brands and Trademarks

Brand names and trademarks (for example, watch or jewelry maker names) are used only to accurately identify pre-owned items. Quality Estate Jewelry is not affiliated with, authorized by, or endorsed by any brand whose products we sell, unless expressly stated. Manufacturer warranties may not transfer to pre-owned items.

7. Pricing, Availability, and Errors

Most of our items are one of a kind and may also be offered for sale elsewhere by our Consignors. An item may become unavailable after you place your order. If that happens, we will notify you, cancel the order, and issue a full refund.

Prices are in U.S. dollars. We try to keep pricing and descriptions accurate, but errors can occur. If an item is listed at an incorrect price or with a material description error, we may cancel the order and refund you in full, even after you receive an order confirmation. An order confirmation email confirms we received your order; it is not our acceptance of it. We accept your order when it ships.

8. Payment, Order Review, and Our Right to Cancel

Payment is processed securely through Shopify and its payment partners. We do not store your full card number.

Because we sell high-value items, every order is subject to review and acceptance by us. An order is not accepted until it ships. We reserve the right, in our sole discretion, to refuse, limit, or cancel any order at any time before shipment, for any reason or no reason, including but not limited to:

• Suspected fraud, unauthorized use of a payment method, or high-risk order indicators
• Billing and shipping information that does not match or cannot be verified
• Requests to ship to a freight forwarder, reshipper, P.O. box, or an address other than the verified billing address
• Inability to reach you to verify the order
• Orders that appear to be placed for resale
• Pricing, description, or availability errors

Order verification. We may ask you to verify your identity, billing address, or payment method before we accept an order. For orders above a certain value, or orders flagged for additional review, we may also require you to electronically sign a purchase acknowledgment and complete identity verification through our verification provider. If verification is not completed within 48 hours of our request, we may cancel the order. We may also require a signature or adult signature on delivery.

Refunds for canceled orders. If we cancel an order, we will void the payment authorization or refund the full amount to your original payment method, with no restocking fee. We are not liable for any loss or inconvenience resulting from a canceled order.

9. Sales Tax

We collect sales tax where required by law, based on the shipping destination. Tax is shown at checkout.

10. Shipping, Title, and Risk of Loss

We ship within the United States only. Processing and delivery times, insurance, and signature requirements are described in our Shipping Policy. Every shipment is insured until it is delivered. Title and risk of loss pass to you when the carrier records delivery to the shipping address you provided. Report missing or damaged packages within 48 hours of the delivery date so we can file an insurance claim.

11. Returns and Refunds

Returns, restocking fees, store credit, and non-returnable items are governed by our Refund Policy. All returns are handled by Quality Estate Jewelry; do not contact or ship items to a Consignor directly unless we instruct you to using our prepaid return label.

12. Payment Disputes

If there is a problem with your order, please contact us first at support@qualityestatejewelry.com. We can usually resolve issues faster than a card dispute. If you file a chargeback, we may provide the card issuer with order, shipping, delivery, signature, and communication records.

13. Acceptable Use

You agree not to use the website to commit fraud; submit false information; interfere with the website's security or operation; scrape, copy, or republish our photos or descriptions without permission; or violate any law.

14. Intellectual Property

The website's content, including photographs, item descriptions, logos, and design, belongs to Quality Estate Jewelry or its licensors and is protected by law. You may not reproduce it for commercial use without our written permission.

15. Third-Party Links and Services

The website may link to or rely on third-party services, such as payment processors, carriers, and social media. We are not responsible for their content or practices.

16. Disclaimers

Except for the express commitments in these Terms (including the Authenticity Guarantee) and our Refund Policy, items are sold "as described," and the website is provided "as is" and "as available." To the extent allowed by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

17. Limitation of Liability

To the extent allowed by law, Quality Estate Jewelry will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law.

18. Indemnification

You agree to indemnify and hold Quality Estate Jewelry harmless from claims arising from your violation of these Terms or misuse of the website.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

20. Changes to These Terms

We may update these Terms from time to time. The version posted at the time of your order applies to that order. Continued use of the website after changes are posted means you accept the updated Terms.

21. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding your use of the website and your purchases.
